هل كان قيء الطفل نجاسة يعفى عنها؟
قال المليباري رحمه الله في فتح المعين : وَأَفْتَى شَيْخُنا (ابن حجر رحمه الله) أَنَّ الصَّبِيَّ إِذَا ابْتُلِيَ بِتَتَابِعِ الْقَيْءِ عُفِيَ عَنْ ثَدْيِ أُمِّهِ الدَّاخِلِ فِي فِيهِ لَا عَنْ مُقَبَّلِهِ أَو مُماسه (فتح المعين ص ٧٢) . وعبارة فتاويه : وسئل رضي الله عنه هل يعفى عما يصيب ثدي المرضعة من ريق الرضيع المتنجس بقيء أو ابتلاع نجاسة أم لا؟ فأجاب رضي الله عنه : ويعفى عن فم الصغير وان تحقق نجاسته كما صرح به ابن الصلاح فقال یعفى عما اتصل به شيء من أفواه الصبيان مع تحقق نجاستها وألحق بها غيرها من أفواه المجانين وجزم به الزركشي اه‍ . واذا تأملت الجواب المذكور تجد فيه أنه لا فرق في العفو عن فم الصبي بين ثدي أمه الداخل فى فيه وغيره من المقبل له والماس له، وليس فيه تخصيص بالثدي المذكور، وسينقل الشارح عن ابن الصلاح ما يفيد العموم فهو موافق لجواب الفتاوى المذكور (إعانة الطالبين حاشية فتح المعين ١ / ٨٤) . والمنقول المذكور عن ابن الصلاح ما نصه : وَقالَ ابْنُ الصَّلَاحِ : يُعْفَى عَمَّا اتَّصَلَ بِهِ شَيْءٌ مِنْ أَفْوَاهِ الصِّبْيَانِ مَعَ تَحَقُّقِ نَجاستِها (فتح المعين ص ٧٥) . وبهذا التعميم قال قلم الإسلام المليباري أيضا (خلاصة الفقه الاسلامي ص ٥١)
والحاصل : أن ما في فم الصبي من القيء معفو عنه مطلقا ولا فرق في العفو عن فم الصبي بين ثدي أمه الداخل في فيه وغيره من المقبل له والماس له
